Questionable Business Practices Leading to the Lawsuit

FanDuel and DraftKings both run similar daily fantasy websites. Some of the biggest prizes in their daily games are frequently rewarded to those who put money on a player that has been selected in the least amount of rosters but ultimately appears in a big game. The class action alleges that employees from DraftKings were permitted to access FanDuel's information and player line-up when that information was kept out of public hands, and vice versa. If true, employees could have a significant advantage by being able to intentionally place a small amount of money on a certain player, based solely on the fact that not many other people had chosen them, and win a major portion of all payouts for that game.

How Are FanDuel and DraftKings Defending Themselves?

A representative of FanDuel has stated that employees of DraftKings have only won about a third of one percent of all winnings given out by FanDuel. The number seems small at first glance but it has been estimated that FanDuel has rewarded a staggering $2 billion at least since its founding. Once again, if this is deemed to be factual, it would suggest that upwards of $6 million in prizes could have been illegitimately collected by DraftKings employees.

In a statement given by DraftKings cofounder Paul Liberman, he claims that some of his company's employees were making more off fantasy league gaming sites – not their own but others – than they were being paid in their salary. While the message was meant to promote how anyone can win and win big, it may suggest that unfair insider practices have been in widespread use for some time now.
