Johnson & Johnson Continues to Face Scrutiny as Talc Powder Lawsuits Advance

An Alameda County, California courtroom is the latest setting for Johnson & Johnson’s (J&J) ongoing legal battle with plaintiffs who allege some of the pharmaceutical giant’s baby powder products could cause ovarian cancer in women who used them for personal hygiene. However, the lawsuits are not implicating just negligence in the manufacturing process. They have taken a serious swing at J&J by alleging the company knew of potential asbestos contamination in their talcum powder products and then intentionally tried to keep that information from the public.

The newly began California trial — which started on January 7th, 2019 — is backed by a mountain of evidence to pursue compensation on behalf of plaintiffs. In mid-December 2018, a Missouri Judge defeated a motion from J&J that asked to toss out a jury verdict of roughly $4.7 billion. The verdict amount was assigned to a collection of 22 plaintiffs who said baby powder used for feminine hygiene – as it had been advertised to be safe for decades, despite the existing of internal, contrary knowledge – caused their ovarian cancer.

The Big Pharma company has not backed down from its argument that talc powder products are safe and do not contain asbestos contamination. Yet the Judge Burlison, who presided over the case in Missouri, accused J&J of “particularly reprehensible conduct” in a response to their motion to reverse the verdict. To evoke such strong language from a professional of the law is indicative of the severity of the company’s wrongdoing and neglect.
