City of Apalachicola Wins Big in BP Disaster Settlement

On April 20, 2010, the Deepwater Horizon offshore drilling rig exploded, starting what would later be called one of the worst environmental disasters in the history of the United States. More than a tragic environmental impact, the aftermath of the event also caused cities all along the Gulf of Mexico to suffer economically as tourism sharply decreased, seafood sales plummeted, and the value of properties dissolved. When the City of Apalachicola needed help finding restitution for the damage that had been done to their community, they turned to David C. Rash P.A. for legal support.

Complicated Case, Comprehensive Representation

The tricky thing about Apalachicola's claims is that the oil from the spill did not enter Apalachicola Bay and it did not directly wash ashore there. Pointing to a particular instance of damages could prove difficult, and Attorney David C. Rash would have to determine the city's losses from more abstract concepts, such as what revenue should have normally been earned yet was not due to the disaster.

In order to bring even more strength to the city's claims, Mr. Rash worked closely with Colson Hicks Eidson out of Coral Gables, Florida. City Attorney Pat Floyd was also called upon during this time of need to assist with the legal project. Together, they were able to construct an intelligent and solid case on behalf of the City of Apalachicola, which was the only municipality in Franklin County that brought a case against British Petroleum (BP).

Due to the lawsuit, BP agreed to pay one million ($1,000,000) in damages to the City of Apalachicola for all the revenue lost in the last five years due to the Deepwater Horizon disaster and the negative cloud it cast of the Gulf Coast's economies.
